Abstract

This research work attempts to address the fundamental issue of admissibility of opinion evidence, under the evidence Act 2023, forensic, and electronic evidence. It made recourse to the world evidence itself as it is the means by which facts are proved excluding inferences and arguments before judicial authorities. There are times in court where it is necessary to produce evidence in order to prove a very vital fact in dispute or issue. This point can be proved through the use of electronically and scientifically generated evidence which is in line with series of the provision of evidence Act 2023. Some of these issues cannot be simply decided by a judicial body without the aid of electronic and scientific expert. Due to the growth in electronic and scientific developments, the use of electronic and forensic evidence has risen rapidly in the world and Nigeria in particular. It is therefore not be out of place to admit evidence of these natures in proof of a fact to which it is relevant in series of decided cases which would be studied therein. The essence of the foregoing is basically to give a detailed and sufficient analysis of the subject matter. As we know tendering and taking of evidence is inevitable in court proceedings and this is set to focus on opinion evidence, electronic and forensic evidence (DNA analysis), their relevance and admissibility under evidence Act 2023.
