Abstract

This comprehensive study on homicide in Nigeria is meticulously structured across five chapters, each contributing to a thorough examination of the legal, institutional, and judicial aspects of homicide cases. The dissertation provides a detailed exploration of the subject matter, ensuring a deep understanding of the complexities involved in homicide cases within the Nigerian context. Chapter One sets the foundation for the research. It begins by outlining the background of the study, providing context and highlighting the significance of examining homicide in Nigeria. This chapter clearly articulates the objectives of the research, detailing what the study aims to achieve. The scope of the study is defined, establishing the parameters and focus areas of the research. The chapter also discusses the methodology employed, explaining the research design, data collection, and analysis techniques. Additionally, a literature review is included to contextualize the research within existing scholarship, identifying gaps that this study aims to fill and drawing on relevant theories and previous studies to support the research framework. Chapter Two delves into conceptual clarifications, providing a comprehensive definition of key terms essential for understanding homicide cases. It defines crucial legal concepts such as crime, actus reus (the physical act of the crime), mens rea (the mental intent to commit the crime), and homicide. The chapter also explores related concepts, providing a broader understanding of the context in which homicide occurs. Furthermore, it discusses the burden of proof in criminal cases, explaining the standards required to establish guilt and the importance of evidence in securing convictions. Chapter Three examines the legal and institutional framework surrounding homicide in Nigeria. This chapter provides an in-depth analysis of relevant legislation, including the Constitution, the Criminal Code applicable in Southern Nigeria, and the Penal Code applicable in Northern Nigeria. It also considers other pertinent acts and legal instruments that govern homicide cases. The chapter outlines the roles and responsibilities of key institutions involved in homicide cases, such as the police, who are responsible for investigations; the courts, which adjudicate cases; and correctional centers, which handle the incarceration and rehabilitation of offenders. This examination highlights the interconnectedness of these institutions and their collective impact on the administration of justice in homicide cases. Chapter Four focuses on the judicial response to homicide, exploring how courts interpret and apply homicide laws and punishments. It details the various stages of homicide cases, from pre-trial procedures to post-conviction processes. This chapter discusses current judicial trends and practices, analyzing how recent case law and judicial decisions shape the handling of homicide cases. Additionally, it examines the roles of different arms of government in addressing homicide cases, including the interplay between the judiciary, the legislature, and the executive in the criminal justice process. Finally, Chapter Five concludes the study by summarizing key points discussed throughout the dissertation. It presents the findings of the research, highlighting significant insights and conclusions drawn from the analysis. Based on these findings, the chapter offers recommendations aimed at improving the legal and institutional responses to homicide in Nigeria. These recommendations are intended to enhance the effectiveness of the criminal justice system in handling homicide cases, ensure justice for victims, and uphold the rule of law. This structure provides a logical progression from foundational concepts to specific legal frameworks and judicial responses, culminating in a synthesis of findings and actionable recommendations.
