DECEASED ORGAN DONATION: AN ISLAMIC LAW PERSPECTIVE
Abstract
ABSTRACT
Allah is the one who gives life, causes death, sickness and health, the importance of donating human organs cannot be overemphasized especially because of the significant role it plays in saving lives which is a very important aspect of Islam. People whose organs are missing, injured, or dysfunctional can receive a new lease on life through the donation of appropriate organs. But the organ procurement procedure brings up moral, legal, medical, societal, and religious concerns. These problems are most noticeable when obtaining organs from donors who are legally deceased from both medical and legal perspectives. The main goal of including deceased donors as potential organ donors is to increase the number of donor organs; however, before life-prolonging organs are obtained, the essential matter that needs to be ascertained with certainty is the potential donor's passing. Nonetheless, there has been disagreement over how to define death from the standpoints of law, medicine, and religion. This research addresses the use of deceased donors' organs for transplantation from the perspective of Islamic law and uses the doctrinal research methodology. It is discovered that improving organ donation practices within the Islamic context requires enhancing education and awareness, ensuring compliance with Islamic guidelines, strengthening legal frameworks, training skilled professionals, and fostering collaboration with Islamic scholars to balance medical needs with religious and ethical considerations.
