Abstract

The regulation of intestate succession in South Eastern Nigeria presents a complex interplay between statutory and customary laws. While statutory laws aim to ensure fair inheritance, customary practices often impose discriminatory restrictions, particularly against women. This study examined the legal framework governing intestacy in South Eastern Nigeria, focusing on the conflicts between statutory provisions and indigenous customs. The primary objective was to analyze the interaction of these legal systems and propose reforms to align customary inheritance practices with constitutional principles of equality and fairness. The research adopted a doctrinal methodology, utilizing statutory analysis, case law review, and field studies to document prevailing customs. Findings revealed that despite judicial interventions, customary norms such as primogeniture and male-dominated inheritance persisted, often undermining statutory safeguards. The study identified three major challenges: legal pluralism leading to inconsistencies, gender discrimination in inheritance rights, and weak enforcement of statutory laws. The study postulated that prompt judicial and legal developments in diverse customary laws, combined with education and legal aid programs, are imperative in addressing these challenges of intestate succession in the region. To address these issues, it recommended the codification of customary laws to eliminate ambiguities and ensure alignment with constitutional rights, judicial and legislative reforms to strengthen statutory protections for vulnerable beneficiaries, and public legal awareness campaigns to educate communities on intestacy rights and promote equitable succession practices. This research elucidated how the interaction of law, culture, and social norms shapes the challenge of regulating intestate estates in South Eastern Nigeria and holds implications for legal reform and social justice. This research ultimately benefits policymakers, legal practitioners, and the judiciary by providing insights into the gaps in intestate succession laws and offering practical solutions for reform.
