DIVORCE: ITS INCIDENCE AND PLACE IN NIGERIA LEGAL AND CULTURAL SYSTEM.
Abstract
This research explores the increasing incidence of divorce within the Nigerian legal and cultural landscape. It examines the dual nature of the Nigerian marriage system—Statutory and Customary—and how each handles the dissolution of marriage. The study analyzes the grounds for divorce, the procedural requirements, and the socio-cultural factors that contribute to marital instability. Findings suggest that while statutory divorce is strictly regulated by the Matrimonial Causes Act, customary divorce remains highly varied across different ethnic groups, often leading to complexities in child custody and property distribution.
