REVIEW OF THE DEFENSE OF PROVOCATION IN NIGERIA USING CASES FROM 2010-2023
Abstract
This study examines the defense of provocation in Nigeria. Provocation is used where an individual's actions are triggered. This study explores the dynamics of provocation cases, analyzing the types of triggers, consequences, and legal outcomes associated with these incidents. Using a mixed-methods approach, combining qualitative and quantitative data, we examine seven (7) provocation cases, identifying patterns and themes related to the nature of the provocation, the perpetrator's motivations, and the impact on victims and communities. Our findings highlight the importance of considering contextual factors, such as cultural norms, social media, and mental health, in understanding provocation cases. We also discuss the implications of our research for legal frameworks, law enforcement practices, and prevention strategies. Ultimately, this study aims to contribute to a deeper understanding of provocation cases, informing evidence-based approaches to mitigate the harm caused by these incidents and promote safer, more resilient communities.
