CUSTOMARY COURTS AND DISPUTE RESOLUTION IN IBADAN NORTH EAST LOCAL GOVERNMENT
Abstract
This study examines the role of customary courts in dispute resolution within Ibadan North East Local Government Area. Customary courts serve as important traditional legal institutions that provide accessible, affordable, and culturally relevant mechanisms for resolving disputes among community members. The study focuses on assessing the effectiveness, challenges, and contributions of customary courts in maintaining peace and justice at the grassroots level.
A descriptive survey research design was adopted for the study. Data were collected through questionnaires, interviews, and relevant legal documents from court officials, litigants, and residents within the study area. The collected data were analyzed using descriptive statistical methods to evaluate public perception and the performance of customary courts in dispute resolution.
Findings from the study revealed that customary courts play a significant role in resolving family disputes, land conflicts, debt issues, and minor civil matters. The courts were found to promote quick settlement of disputes and preserve communal harmony through the application of customary laws and mediation processes. However, challenges such as inadequate funding, lack of public awareness, and limited legal resources were identified as factors affecting their effectiveness.
The study concludes that customary courts remain essential institutions for grassroots justice delivery and conflict resolution. It recommends improved government support, public enlightenment, and capacity building for court personnel to strengthen the efficiency and credibility of customary courts in Nigeria.
