ONLINE DEFAMATION AND MEDIA RIGHT: AN ANALYSIS

ABSTRACT Online defamation and media rights is an evolving topic because it raises a number of important legal and social issues and this is due to the fact that internet is a global platform. Media outlets have the right to freedom of expression, but this right is not absolute. Media outlets have a duty to report the truth accurately and fairly, and they can be held liable for defamatory content that they publish. However, media outlets also have the right to protect their sources and to publish controversial or unpopular opinions. The research emphasizes the pressing need to strike a delicate balance between safeguarding freedom of expression and protecting individuals and entities from reputational harm. It explores the challenges and complexities associated with regulating online defamation, highlighting the nuances of jurisdiction and jurisdictional challenges in an interconnected world. Some research gaps are the factors that contribute to the prevalence of online defamation despite existing laws and regulations, how effective are current enforcement mechanisms in addressing online defamation. And some specific proposals to solve the gaps in the research on online defamation and media rights are to enhance public awareness and education about online defamation, including its legal and social consequences. Strengthen enforcement mechanisms by allocating adequate resources to investigative bodies and providing clear guidelines for handling online defamation cases, and investigate the jurisdictional challenges of online defamation and propose solutions to address them.
